Terms of Service

1. Acceptance of terms

By downloading, installing, or using the Smart Calorie Tracker app, or by using this website, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the app or website.

2. Eligibility

You must be at least 13 years old to use Smart Calorie Tracker. In the European Economic Area, the United Kingdom, and any jurisdiction that requires a higher age of digital consent, you must be at least 16 years old. In India, if you are under 18 years of age, you may use Smart Calorie Tracker only with the verifiable consent of a parent or legal guardian, as required by the Digital Personal Data Protection Act, 2023. By creating an account, you confirm that you meet the applicable age requirement.

3. Account responsibilities

  • Provide accurate information when creating your account.
  • Keep your sign-in credentials confidential.
  • You are responsible for activity on your account. Notify us immediately at support@smartcalorietracker.app if you suspect unauthorized access.
  • One person per account. Sharing accounts is not permitted.

4. Medical disclaimer

Smart Calorie Tracker is provided for general wellness and informational purposes only. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease.

  • The app is not a substitute for professional medical advice, diagnosis, or treatment.
  • Consult a qualified healthcare provider before starting any diet, supplement, or exercise program, and before acting on any information produced by the app.
  • Nutrition information sourced from AI providers (including Anthropic Claude and OpenAI), FatSecret, OpenFoodFacts, or your own input may be inaccurate or incomplete. Always review the values before logging.
  • Calorie and macro targets (BMR and TDEE) are estimates based on the Mifflin–St Jeor formula and are not clinical measurements.
  • Do not rely on the app to manage medical conditions including but not limited to diabetes, eating disorders, pregnancy, and chronic illness.
  • If you are experiencing symptoms of an eating disorder, please contact a qualified professional.

5. Acceptable use

You agree not to:

  • Reverse engineer, decompile, or tamper with the app.
  • Scrape or copy any content from the app or website.
  • Use the app to violate any law or third-party right.
  • Upload malicious code, spam, or infringing content.
  • Attempt to access accounts, data, or systems that do not belong to you.

6. License grant

Subject to these Terms, Smart Calorie Tracker grants you a personal, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control, for personal and non-commercial use.

7. Intellectual property

The app, website, logos, icons, copy, and underlying software are owned by Smart Calorie Tracker or its licensors and are protected by intellectual property laws. These Terms do not transfer any ownership rights to you.

8. User-submitted content

You retain ownership of photos, notes, and other content you submit through the app. By submitting content, you grant Smart Calorie Tracker a limited, worldwide, royalty-free license to store, process, and display it as needed to provide the service to you. We do not use your content for advertising.

9. Third-party services

The app integrates with third-party services including Apple Health, Google Health Connect, Google Fit, Firebase, Anthropic Claude, OpenAI, FatSecret, and OpenFoodFacts. Smart Calorie Tracker is not responsible for the availability, accuracy, or policies of these services. Your use of a third-party service is governed by that provider's terms.

10. Subscriptions

Smart Calorie Tracker offers auto-renewable subscriptions (e.g., Premium Monthly and Premium Yearly). The subscription title, duration, and price for each plan are displayed within the app on the subscription screen before you confirm a purchase.

Apple App Store (iOS). Payment will be charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price as your current plan, unless we have notified you of a price change in advance. You can manage your subscription and turn off auto-renewal by going to your Apple ID Account Settings after purchase. Deleting the app does not cancel your subscription.

Google Play (Android). Payment will be charged to your Google Play account at confirmation of purchase. Your subscription automatically renews at the then-current price for the same period unless you turn off auto-renewal at least 24 hours before the end of the current period. We will notify you of any price change in advance, as required by Google Play. You can manage your subscription and turn off auto-renewal by opening the Google Play app and going to Menu → Payments & subscriptions → Subscriptions, or by visiting play.google.com/store/account/subscriptions. Deleting the app does not cancel your subscription.

Free trials. Where a free trial is offered, any unused portion of the trial period will be forfeited when you purchase a subscription during that trial. The trial converts automatically to a paid subscription at the end of the trial period unless you cancel before it ends.

Refunds. Refunds for App Store purchases are handled by Apple in accordance with Apple's policies; please contact Apple Support to request a refund. Refunds for Google Play purchases are handled by Google in accordance with Google's policies; please contact Google Play Support to request a refund.

11. Termination

You may delete your account at any time from inside the app or by following the steps on our Account Deletion page. We may suspend or terminate accounts that violate these Terms, with notice where practicable.

12. Disclaimer of warranties

The app and website are provided “as is” and “as available” without warranties of any kind, whether express or implied. Smart Calorie Tracker does not warrant that the service will be uninterrupted, error-free, secure from intrusion, or that nutrition data will be accurate.

13. Limitation of liability

To the fullest extent permitted by law, Smart Calorie Tracker and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim arising out of these Terms or the service is limited to the greater of the amount you paid us in the 12 months before the claim or INR 8,000 (approximately USD 100).

14. Indemnification

You agree to indemnify and hold Smart Calorie Tracker harmless from any claim or demand, including reasonable legal fees, arising out of your misuse of the app or violation of these Terms.

15. Governing law and disputes

These Terms are governed by the laws of India and, specifically, the laws of the State of Karnataka, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and the Consumer Protection Act, 2019, without regard to conflict-of-laws principles. The courts located in Bengaluru, Karnataka, shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, unless applicable consumer-protection law in your country of residence provides otherwise.

16. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will notify you in-app and, where we have your email on file, by email, at least 30 days before the change takes effect. Continued use of the app after the effective date constitutes acceptance of the updated Terms.
